This highly complex area has been a prominent part of Polk & Associates' practice since the firm's inception in 1996.  Our attorneys  have represented insurers in declaratory judgment actions against insureds and other insurers. The firm has served as coverage counsel for several carriers.

Insurance Coverage

Polk & Associates has an extensive insurance coverage practice in which the firm:

  • provides coverage opinions, reservation of rights letters and non-waiver agreements for all types of policies-- P&C, Auto, E&O, Workers' Compensation, Life and Health;
  • litigates the carrier's duty to defend and duty to indemnify;
  • serves as monitoring counsel in litigation against the insured;
  • serves as coordinating counsel for recurring national and regional litigation;
  • defends the carrier from extra-contractual claims and allegations of bad faith;
  • handles apportionment and contribution disputes between primary/excess/umbrella carriers and self insureds;
  • counsels clients on compliance issues raised by the Texas Department of Insurance; and
  • resolves premium finance disputes and premium collection lawsuits.

We also advise clients on policy drafting and interpretation, claims analysis and management, litigation avoidance, alternative dispute resolution and the use of cost-saving technologies such as comprehensive coverage charts.
